Dear licence holder

RE: APPLICATION FOR PERMIT TO ACQUIRE

As you are all aware, the Weapons Licensing Branch has experienced many changes relating to legislation over the last couple of years. Points of law and procedures are continually drawn to our attention. As time progresses changes will occur that are required. Hence you will have noticed the recent changes to our procedures for the approval of permit to acquire applications.

If an application is for a permit to acquire a category B, C, D or H weapon, the applicant must state why the applicant needs the weapon, and why the need can not be satisfied in another way. Refer section 40 (2) of the Weapons Act 1990.

Under section 39 of the Weapons Act 1990, a permit to acquire a weapon may be issued to an individual only if the person is licensed to possess the weapon and for a category B, C, D or H weapon has a need to possess the weapon.

For the Weapons Licensing Branch to fulfil its requirements under legislation, a person who has 2 firearms of the same category, calibre and action must provide the following information:
(i) the need for the acquisition of this weapon, and
(ii) why the need can not be satisfied in another way

Where a person acquires a category B, C, D or H firearm of another configuration, the need must be specified, i.e. different shooting competitions, different species of animals hunted (rabbits as opposed to pigs).

It should also be noted that these procedures are not applicable to collectors licences or category A firearms.

Any applications that do not provide this information will be returned to the applicant for further information before a determination is made.
